Terms of Service

These Terms of Service ("Terms") govern your access to and use of ClickSpool ("ClickSpool", "we", "us", or "our"), a session-replay and analytics service. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

ClickSpool is an independently operated service run by a small team. We are not a large enterprise vendor. We do not offer guaranteed uptime, dedicated support SLAs, formal security certifications, or enterprise assurances. We provide the Service on a good-faith, best-effort basis within our means, and by using it you acknowledge and accept this. If your use case requires guaranteed availability, formal audits, or enterprise-grade assurances, ClickSpool may not be the right fit for you.

1. The Service

ClickSpool lets you record, replay, and analyze how visitors interact with websites you own or control ("Your Sites"), including mouse movement, scrolling, clicks, navigation, and aggregated heatmaps. We may add, change, or remove features at any time.

2. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account. Notify us promptly of any unauthorized use. You must be at least 18 years old and able to form a binding contract. One person or entity per account unless otherwise agreed.

3. Your responsibilities and lawful use

You are solely responsible for how you deploy and use the Service, and for the data you collect through it. In particular, you represent and warrant that:

You own or have the right to install the ClickSpool tracking script on Your Sites and to record the visitors to them.
You have a valid legal basis to collect, process, and store visitor data under all applicable laws (including, where relevant, GDPR, UK GDPR, CCPA/CPRA, and other privacy and electronic-communications laws), and you will obtain any consent those laws require.
You maintain your own privacy policy that accurately discloses your use of session recording and analytics, and you present any legally required notices or cookie/consent banners to your visitors.
You will not use the Service to record passwords, payment card numbers, government identifiers, health information, or other sensitive personal data, and you will use the masking, blocking, and exclusion tools provided to prevent such capture.
You will not use the Service to record sites you do not control, to surveil individuals unlawfully, or for any illegal, deceptive, infringing, or harmful purpose.

4. Data roles

For personal data of visitors to Your Sites, you are the data controller and ClickSpool is a data processor acting on your instructions. You are responsible for the lawfulness of the data you collect. We process such data only to provide the Service. For your own account information, we act as controller as described in our Privacy Policy.

5. Fees, billing, and refunds

Paid plans are billed in advance on a recurring basis. Fees are non-refundable except where required by law. You authorize us (and our payment processor) to charge your payment method for all fees. We may change pricing on prospective notice. Failure to pay may result in suspension or downgrade. Applicable taxes are your responsibility. Plan limits (such as recorded sessions per month, retention periods, and number of sites) may be enforced, and usage beyond your plan may be throttled, dropped, or require an upgrade.

6. Availability, outages, and changes

The Service is provided on an "as available" basis. We do not guarantee any level of uptime, availability, performance, or data durability. The Service may be unavailable due to maintenance, upgrades, failures, third-party outages, or causes beyond our control, and recordings may be delayed, incomplete, or lost. We are not liable for any interruption, degradation, data loss, or corruption. You are responsible for maintaining your own backups of any data you consider important.

7. Acceptable use

You will not: (a) reverse engineer, resell, or provide the Service to third parties except as expressly permitted; (b) interfere with or overload the Service or its infrastructure; (c) attempt to gain unauthorized access to any system or data; (d) upload malware or unlawful content; or (e) use the Service to violate the rights of others. We may suspend or terminate accounts that violate these Terms, with or without notice.

8. Intellectual property

ClickSpool and all related software, trademarks, and content are owned by us or our licensors. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service. You retain ownership of the data you collect through the Service.

9. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT DATA WILL BE ACCURATE OR PRESERVED.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL CLICKSPOOL OR ITS OWNERS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Indemnification

You will defend, indemnify, and hold harmless ClickSpool and its owners, employees, and suppliers from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) the data you collect or process through the Service; (c) your violation of these Terms or applicable law; or (d) your violation of the rights of any third party, including your Sites' visitors.

12. Suspension and termination

You may cancel at any time from your account settings. We may suspend or terminate your access at any time, with or without cause or notice, including for non-payment or violation of these Terms. Upon termination, your right to use the Service ends and we may delete your data. Sections that by their nature should survive termination will survive.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with an updated date, and your continued use after changes take effect constitutes acceptance.

14. Governing law and disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Texas for any dispute arising out of or relating to these Terms or the Service, and you waive any objection to that venue.

15. Miscellaneous

These Terms and our Privacy Policy are the entire agreement between you and us regarding the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them freely.
